Terms & Conditions of Service - Home & Garden Care

1. Scope of Services
Home & Garden Care Services are intended to help maintain the general condition of a home and garden during the owner's absence. Rain & Winds does not provide professional gardening, horticultural, landscaping, arboricultural or plant health services and no specialist expertise is claimed or implied.
Services may include:

Watering indoor and outdoor plants

Collecting post and deliveries
-
Managing bins
-
Opening and closing curtains or blinds

Rotating lights
-
Visual property and security checks
-
Other agreed tasks confirmed in writing
All services will be carried out in accordance with the client's instructions.
Whilst every reasonable effort will be made to care for plants and maintain the condition of the property, Rain & Winds cannot guarantee the health, growth, flowering or survival of plants, nor prevent deterioration, damage or loss arising from weather conditions, pests, disease, utility failures, security incidents or other circumstances beyond reasonable control.
2. Bookings & Payments
Regular Bookings
Regular bookings are invoiced monthly in advance. Payment must be received before services commence.
A minimum of one week's notice is required for cancellations or amendments.
Cancellations made with less than one week's notice are non-refundable.
Ad-Hoc Bookings
A non-refundable deposit may be required for ad-hoc bookings.
Dates will not be secured until the agreed deposit has been received.
Full payment is required one week before the first scheduled visit.
For bookings made within one week of the first scheduled visit, full payment is required in advance.
3. Cancellations & Changes
A minimum of one week's notice is required for cancellations or changes.
Where at least one week's notice is provided, services may be credited or refunded.
Bookings made within one week of the first scheduled visit are considered short-notice bookings and are normally non-refundable.
4. Service Times
Whilst every effort will be made to attend at preferred times, exact visit times cannot be guaranteed.
Service times may vary due to traffic, weather, emergencies, illness, client requests or other circumstances beyond reasonable control.
Clients are booking a service within an agreed time period rather than a guaranteed appointment time.
5. Property & Access
The client confirms that the property is safe and suitable for access.
The client is responsible for ensuring that keys, access codes and entry instructions provided are accurate and functional.
Rain & Winds is not responsible for:

Pre-existing property damage

Security faults
-
Utility failures
-
Loss resulting from faulty locks, doors, gates, windows or alarm systems
In the unlikely event that a key, fob or access device is lost due to negligence, liability shall be limited to the reasonable cost of replacement.
6. Liability
Whilst every reasonable effort will be made to follow the client's instructions and care for plants appropriately, Rain & Winds cannot guarantee the health, growth, flowering, survival or ongoing condition of any plant, lawn, shrub, tree or garden feature. Plant deterioration, disease, pest damage, weather-related impacts and other factors beyond reasonable control remain the responsibility of the owner.
Liability shall be limited to losses arising directly from proven negligence.
7. CCTV & Security Devices
Clients should notify Rain & Winds of any CCTV systems, video doorbells or other recording devices operating at the property.
The use of such devices for security purposes is accepted; however, Rain & Winds reserves the right to refuse or discontinue services where recording arrangements are considered inappropriate or compromise the safe and professional delivery of services.
8. Suspension & Termination of Services
Either party may terminate ongoing services by providing a minimum of one week's written notice.
Rain & Winds reserves the right to suspend, refuse or terminate services immediately where:

Access cannot be safely obtained

Information provided is inaccurate or misleading

Payments remain outstanding

Unsafe property conditions exist
- The service provider is subjected to threatening, abusive, aggressive, discriminatory, intimidating or inappropriate behaviour by a client, member of the household, visitor, neighbour or any other person connected with the provision of services.

Circumstances prevent services from being provided safely, legally or professionally
9. Circumstances Beyond Control
Rain & Winds shall not be liable for failure to provide services due to circumstances beyond reasonable control, including severe weather, illness, road closures, emergencies or government restrictions.
Every effort will be made to reschedule visits where possible.
10. Privacy & Data Protection
Personal information will be collected and retained only as necessary to provide services, maintain records and fulfil legal obligations.
Information will be treated as confidential and will not be shared with third parties except where required by law.
11. Client Declaration
By engaging the services of Rain & Winds, the client confirms that they have read, understood and agree to these Terms & Conditions.
